The Supreme Federal Court (STF), the National Congress, and the Brazilian government have reached an agreement that will maintain the possibility of constitutional amendments while establishing new criteria for their proposal and approval. This agreement aims to balance the need for constitutional reform with the importance of preserving the stability and integrity of the Brazilian Constitution.

The new criteria include requiring a qualified majority of three-fifths of both the Chamber of Deputies and the Federal Senate to approve amendment proposals. Additionally, amendments that affect fundamental rights or the structure of the state will require a subsequent referendum for final approval. These measures are intended to ensure that constitutional changes are carefully considered and have broad support from the Brazilian people.

The agreement also establishes a new process for the proposal of constitutional amendments. Previously, amendments could be proposed by any member of Congress or the executive branch. Under the new system, only the President of the Republic, the President of the Chamber of Deputies, or the President of the Federal Senate will be able to initiate amendment proposals. This change is designed to streamline the amendment process and prevent frivolous or partisan proposals from being considered.
